Faced with a serious accident, the employer may incur civil liability, essentially for unpardonable error (faute inexcusable), with financial penalties that may go as high as several hundred thousand, perhaps even several million Euros. The Labour Inspector, police or gendarmerie will investigate possible disregard for safety rules, that may lead to an indictment, and to criminal proceedings against the company and its executives.
- A fatal accident may not necessarily be an industrial accident: it may occur through a traffic accident, a sudden indisposition, suicide…
- How and when to declare an industrial accident
- Handling an investigation by the Labour Inspector, the police or the gendarmerie
- Taking the most urgent provisional measures
- Adopt a line of defence in criminal proceedings
- Keeping down compensation costs
- Impact of third-party misconduct/negligence
With our partners Bruno Fieschi and Laurent Gamet
Event takes place at 8.30am, at the Maison des arts et métiers. Registration here, free of charge.
